சட்டம் முன் அனைவரும் சமம்

Article 14 சொல்றது:
"Equality before law" + "Equal protection of laws."

  • "Equality before law" → எந்த ஆளும் சட்டத்துக்கு மேல் இல்லை. Minister, officer, rich businessman, ordinary worker – எல்லாருக்கும் ஒரே சட்டம்.
  • "Equal protection of laws" → ஒரே போன்ற situation-ல இருக்கும் மக்களுக்கு ஒரே மாதிரி சட்டப் பாதுகாப்பு கிடைக்கணும்.

ஆனால் practical-ஆ inequality இருந்தால் என்ன?

  • அங்கத்தான் reasonable classification use பண்ணறாங்க:
  • குறும்பிரிவுகளுக்கு reservation,

இது எல்லாம் equality-க்கு எதிரா இல்ல;
"Unequals cannot be treated as equals"ன்னு கூறும் justice principle-ஐ follow பண்ணுது.

Equality உரிமையின் 5 முகங்கள்

Art 14 – Equality before law

எந்த ஆளும் சட்டத்துக்கு மேலில்லை; similar cases நா similar treatment.

Art 15 – Discrimination ban

சாதி, மதம், பாலினம், பிறப்பிடம் அடிப்படையிலான எளிதில் பாகுபாடு இருக்கக்கூடாது.

Art 16 – வேலை வாய்ப்பில் சமத்துவம்

Public employment-ல equal opportunity; reservation provisions allowed.

Art 17 – Untouchability நீக்கம்

அடிமைத்தனம், அச்சம், தாழ்வு உணர்வு கொண்டு பிறரைக் கீழ்த்தரமா treat பண்ணுற practice முழுமையாக தடை.

Art 18 – Titles abolition

"Rai Bahadur", "Sir" மாதிரி hereditary titlesக்கு full stop; only academic / military titles ok.

ஒரு simple story மூலம் equality புரிஞ்சுகலாம்

  1. ஒரே exam எழுதுற இரண்டு மாணவர்கள் – ஒருத்தர் poor, ஒருத்தர் rich.
  2. Question paper எல்லாருக்கும் same; correction criteria same – இது basic equality.
  3. But poor studentக்கு free coaching / scholarship scheme கொடுக்கலாம் – இது protective measure.
  4. இது injustice இல்ல; starting line ஒரே levelக்கு கொண்டு வர justice-னு சொல்லலாம்.
