Parliament (Art 302)
தேசிய நலன், பாதுகாப்பு, அவசரநிலை, பொருளாதார சீர்கேடு காரணங்களுக்காக restrict முடியும்.
State (Art 304(b))
மாநிலம் restrict முடியும், ஆனால் **President Assent** அவசியம் + reasonable ஆக இருக்க வேண்டும்.
Art 303 – No Preference
ஒரு மாநிலத்தை ஏற்றுக்கொண்டு இன்னொரு மாநிலத்தை புறக்கணிப்பது சட்டவிரோதம்.
Art 304(a) – Equal Tax
அருகில் உள்ள மாநிலத்திலிருந்து வரும் பொருட்களுக்கு, தங்கள் மாநிலப் பொருட்களுக்கு விதிக்கும் வரியை விட அதிக வரி விதிக்கக் கூடாது.
Existing Laws (Art 305)
முன்னமே இருந்த monopoly laws (liquor, sugarcane) தொடர அனுமதி உள்ளது.
Parliament பங்கு (Art 302) – காரணங்கள்
- நாட்டின் பாதுகாப்பு.
- அவசரநிலைகள்.
- மருந்துகள்/உணவு போன்ற பொருட்களுக்கு ஒழுங்கு.
- மோசடி தடுப்பு.
- Foreign trade imbalance correction.
மாநில பங்கு (Art 304(b)) – நிபந்தனைகள்
- Restriction **reasonable** ஆக இருக்க வேண்டும்.
- Bill மாநில சட்டமன்றத்தில் நிறைவேற்றப்பட வேண்டும்.
- **President Assent** அவசியம்.
- Discrimination ஆக்கக்கூடாது.
Practical Examples – Exam Style
- TN → Karnataka இருந்து வரும் காய்கறிகளுக்கு கூடுதல் வரி விதிக்க கூடாது (Art 304(a) violation).
- Kerala → Tamil Nadu பொருளுக்கு road tax மட்டும் சமமாக விதிக்கலாம் (Valid).
- Parliament → Essential commodities மீது வர்த்தக கட்டுப்பாடுகளை விதிக்க முடியும் (Art 302).
- Entry tax → சட்டபூர்வம் only if non-discriminatory.
- Liquor state monopoly → Art 305 மூலம் செல்லுபடியாகும்.
- Pollution control trade restriction → Valid (reasonable restriction).
